China Association to Foreign Office.-(Received November 24).

Dear Mr. Alston,

159, Cannon Street, London, November 20, 1908. I THINK it only right to inform you, unofficially, before waiting for a meeting of my Committee, that the portion of the Association's letter of the 5th ultimo to your Department dealing with the alleged infringement of Messrs. Dewhurst's Eagle" trade-mark was based on a misapprehension on their part of the facts. As the complaint came from the owners of the mark, my Committee felt justified in regarding the information as accurate; but the inclosed letter from Messrs. Dewhurst's explains how the misunderstanding arose. I feel sure the Committee will regret that your Department was troubled with the matter, more particularly because there are so many cases of actual infringement which require attention.

Great Marlborough Street, Manchester, Dear Sir,

November 17, 1908. REFERRING to our recent letters to your Association regarding our "Eagle' trade-mark, which we were informed was being pirated in Japan, we beg to inform you that we have just heard from our friends abroad that a misunderstanding has arisen, owing to the fact that the name of the supposed registrar was mistranslated.

We find that our chop was registered in 1906 by Mr. J. D. Hutchison, who did this unbeknown to us, in our interests, and unfortunately omitted to tell us what had been done.

The characters referring to the mark in the Japanese registration book were translated as "James David Hudson," and consequently, as you know, we were very anxious about the matter. Everything, however, is now made clear, and we have only to apologize to your Association for any trouble we may have given you.
